Mother finally to receive compensation six years after crash
15:03:00 Wednesday 7th January 2009A mother-of-two has been told she is in line for a payout of as much as £500,000 six years after she and her children were injured in a car crash.
The crash occurred when the claimant's car was hit by a stolen Peugeot. She received head injuries and broke bones in her arms, chest and pelvis, while her children also suffered broken bones.
Her initial claim, made in 2006, failed after solicitors left it too long to serve the insurer, within the time limit for such cases. When she appointed new solicitors, the three year maximum time period since the accident had lapsed and her claim was again put in jeopardy.
However, a county court judge later waived the time limit, allowing the claimant to continue with her claim against the insurer who tried to appeal the country court decision. The appeal has now finally been rejected and she has been told she is entitled to a full compensation payout.
The claimant says she has been constantly in and out of hospital since the accident and the children have missed school because of it. She was due to begin a career as a teacher before the accident and she considers her loss of earnings to total around £100,000.
