Supermarket Injury Claims
Claiming compensation after a supermarket injury
When we visit the local supermarket, we expect to be able to pick up our shopping safely and come home. No one expects to get injured just while doing their weekly grocery shop. Unfortunately, supermarket injuries can happen but they are usually completely preventable. So if you have been injured in the supermarket or in any other shop or store, it is very likely the store can be held responsible for your injuries.
Accidents at the supermarket can be particularly distressing partly because they are so unexpected. While some injuries can be relatively trivial, they can sometimes cause more serious injuries. Whether you’ve tripped over something on the floor, slipped on a spilt carton of milk or a heavy object has fallen from a shelf and hit your head – you deserve to claim compensation.
We understand how daunting it is even thinking about bringing an injury claim against the likes of Sainsbury’s or Morrisons, but that’s what we’re here for. Get in touch with us and we will guide you sensitively through each step of your compensation claim. Contact our friendly advisors on 0800 0511 511
Guidance on supermarket injury claims
The reality is, accidents can and do happen in supermarkets and other shops. If you think about it, the potential risks are real and the store must deal with them. They include spills of liquid on the shop floor, trolleys of produce; stacked displays; escalators and lifts; and even hazards in the car parks such as uneven paving.
As a public place, supermarkets owe a duty of care to you and other shop visitors to minimise the risk of injury. This includes carrying out risk assessments to identify the potential risks, and doing something about what the risk assessment reveals.
So the fact that you have been injured in a supermarket suggests that they have failed in some way, leading to the accident and your injuries. This means it is only fair that you should be entitled to bring a compensation claim. Our friendly advisors will help you make the first step to getting the compensation you deserve.
It can be reassuring to know that your specialist solicitor will take on your claim on a no win no fee basis. This means there will be no financial risk to you – so if your supermarket claim does not succeed you won’t have to pay out anything.
If you win, your legal fees will be a percentage of the compensation you win. Your solicitor will talk you through how this works.
What types of injuries can happen?
The types of injuries that can be caused in supermarket accidents vary greatly depending on what the cause was. For instance, a trip or slip accident can lead to bruising and bone fractures; trolleys with nails or pieces of metal sticking out can cause cuts and sometimes deeper wounds; and top-heavy free-standing displays of seasonal goods can collapse onto someone, causing crush injuries.
It’s not difficult to see how these types of accident and injury could have been avoided. Your solicitor will talk you through the circumstances of your injuries and the impact on your life, then explain the next steps in mounting a strong claim for you.
It’s always best to make your supermarket injury claim as soon as you can while things are still fresh in your mind. Call our friendly advisors now on 0800 0511 511:
How much will I win?
This is a good question. It’s perfectly natural to think about how much compensation you should win when you’re thinking of making a claim. However, it really depends on your injury and how long it will take you to fully recover.
Your specialist injury solicitors will discuss the nature of your injuries with you and may be able to give you a good idea of what you can expect to claim.
Lawyers do have the benefit of formal guidelines on compensation which give a guide on what level of compensation may be appropriate, depending on the injuries. These are called the Judicial College Guidelines. It suggests, for example:
- Arm or shoulder injury - £3,240 to £63,450
- Minor back injuries - £3,240 to £16,520
- Elbow injuries - £4,670 up to £72,440
- Minor soft tissue injury up to £3,240
This shows that you need guidance from a specialist lawyer to understand what level of compensation you deserve. It is reassuring to know that our specialist panel solicitors are all experienced in securing the maximum possible compensation injured individuals deserve.
You could also use our online compensation calculator here. This can be useful in giving you a rough guide on how much you might deserve.
As well as compensation for your actual injuries, you can also claim what are known as ‘special damages’. This is additional sums of money to ‘pay you back’ for anything you’ve had to spend as a direct result of the accident at the supermarket.
You can, for example, claim for items such as:
- Loss of wages, overtime and bonuses
- Travel expenses, prescription costs and medical costs such as physiotherapy
- A loved one’s loss of earnings if they’ve had to take time off work to care for you
You don’t need to worry too much about what you can or can’t claim for because your specialist lawyer will discuss these issues with you. If you have any concerns, they will be more than happy to put your mind at rest.
